O<\/u>TERMS AND CONDITIONS OF "JOURNEY GROUP" LTD FOR ORGANIZED TOURIST TRAVEL WITH TOTAL PRICE<\/u><\/span><\/strong><\/h4>

I.\u00a0<\/u><\/span>ENROLLMENT<\/u><\/span><\/strong><\/span><\/p>

Article 1. (1).<\/span>The USER has the right to sign up for a tourist trip by making a reservation on<\/span>\u00a0the phone,\u00a0<\/span>e\u2013<\/span>mail, through an Internet form or Travel Agent. When making a reservation through a travel agent, all questions related to the trip are settled by the latter. The information provided in the offices of the TOUR OPERATOR related to the organized tourist trip is up-to-date and has priority over data from other information sources (the TOUR OPERATOR's website, advertising brochures, etc.).<\/span><\/p>

(2)<\/span>\u00a0The reservation made by the USER is kept for 1 working day and is valid after signing the Contract for an organized tourist trip and paying a deposit. in the amount of 30% per person from the amount due. The remaining amount in the amount of 70% is paid at least 14 \/fourteen\/ working days before the start date of the organized tourist trip.<\/span><\/p>

(3)<\/span>\u00a0The contract for an organized tourist trip (DOTP) binds "Journey Group" Ltd. upon full payment of the price under the contract on time.<\/span><\/p>

(4)<\/span>\u00a0The person who made the reservation declares and guarantees to the TOUR OPERATOR that all other persons entered in the contract as participants in the trip agree to the terms of the contract, and guarantees on his own behalf and on behalf of the other persons included in the trip, the payment of the price under the contract on time.<\/span><\/p>

<\/a><\/strong><\/p>

II<\/u>. VISAS<\/u><\/span>. MEDICAL AND HEALTH REQUIREMENTS<\/u><\/span><\/strong><\/span><\/p>

Art. 2. (1)<\/span>\u00a0For trips to countries for which passports and visas are required for Bulgarian citizens,<\/span>\u00a0THE TOUR OPERATOR\u00a0<\/span>e\u00a0obliged to provide the USER with information in writing or in another appropriate way about the passport and visa regime, the deadlines for obtaining the necessary documents and the fees payable for issuing visas.<\/span><\/p>

(2)<\/span>\u00a0The due fees for issuing the visas are not included in the price of the organized tourist trip and are due and paid additionally by the USER.<\/span><\/p>

(3)<\/span>\u00a0At the USER's request, the TOUR OPERATOR can assist in obtaining a visa. In the event that the TOUR OPERATOR prepares and submits the USER's documents to the relevant embassy, the latter is obliged to provide the TOUR OPERATOR with all the documents required by the Embassy, as well as to pay the visa fees in advance. Failure to present documents, failure to pay fees or failure to appear at the embassy for a personal interview, if one is required, shall be considered a denial of the trip due to the USER's fault.<\/span><\/p>

(4)<\/span>\u00a0Issuing a visa for the respective country is the sole authority of its embassy and is not guaranteed by the TOUR OPERATOR. In the event of a refusal by the Embassy to issue a visa to the USER and\/or any of the other persons registered as participants in the trip in DOTP, the fees paid by the USER and\/or other persons, participants in the trip for the issuance of a visa\/and not are returning. The amount of fees for issuing visas is indicated in the information provided by the TOUR OPERATOR under Art. 80 of ZT.<\/span><\/p>

(5)<\/span>\u00a0For USERS - foreign citizens traveling on the territory of the Republic of Bulgaria, at the USER's request and if possible, the TOUR OPERATOR provides assistance for entry\/exit and stay within the country, including obtaining a visa and\/or other necessary documents, without to undertake any commitments that are within the competence of the authorized state bodies and institutions or other third parties. The USER is responsible for the regularity and validity of his identity documents, including the foreign passport.<\/span><\/p>

(6)<\/span>\u00a0The USER is obliged to familiarize himself in detail with the currency and customs regime and the conditions for entry\/exit and stay in the territory of the Republic of Bulgaria.<\/span><\/p>

I<\/u><\/span>II<\/u>. PRICES<\/u><\/span>, TERM AND MANNER OF\u00a0<\/u><\/span>PAYMENT<\/u><\/span><\/strong><\/h4>

Art. 3. (1)<\/span>\u00a0The price of the organized tourist trip is paid<\/span>\u00a0in compliance with the requirements of ZOPB<\/span>\u00a0in BGN, in cash or by bank transfer to the account of<\/span>\u00a0TOUR OPERATOR and in accordance with the official fixing of the BNB on the day of payment (in case the organized trip is priced in BGN and in foreign currency).<\/span><\/p>

  1. Unless otherwise agreed in the DOTP, the amount of the deposit payable by the USER is 30 % (thirty percent) of the total price of the organized tourist trip. In the absence of any other arrangement, the payment of the deposit is due at the time of signing the DOTP.<\/span><\/p><\/li>

  2. The final payment of the price of the organized tourist trip is due up to 20 (twenty) days before the date of the trip, unless otherwise agreed in the DOTP.<\/span><\/p><\/li>

  3. The total price agreed in the DOTP for the organized tourist trip can be increased subject to compliance with the requirements of Art. 88 of the TZ no later than 20 days before the start date of the trip.<\/span><\/p><\/li>

  4. Early bookings are valid upon reservation and payment of a percentage of the total price according to the promotional conditions announced for each hotel.<\/span><\/p><\/li><\/ol>

    IV<\/u>. INCREASE IN THE PRICE OF THE ORGANIZED TOURIST TRIP. CHANGES IN DOTP. TRIP CANCELLATION<\/u><\/span><\/strong><\/h4>

    Art. 4 (1)<\/span>\u00a0An increase in the price of the organized tourist trip is possible in the following cases: change in transport costs \/increase in fuel prices\/; change of airport, port charges, etc.; in the event of a change in the exchange rate related to the contract in the period between the date of conclusion of the contract and the date of departure.<\/span><\/p>

    (2)<\/span>\u00a0The change in price must be economically justified and correspond to the changed costs of the TOUR OPERATOR.<\/span><\/p>

    (3)<\/span>\u00a0In the event of an increase in the price of the trip by more than 5% or another significant change to the main clause of the DOTP, the TOUR OPERATOR undertakes to inform the User directly or through the Travel Agent in writing within two days of the occurrence of the circumstances under the previous paragraph but no later than 10 days before the travel start date.<\/span><\/p>

    (<\/span>4<\/span>)<\/span>\u00a0Within three days from the date of receipt of the notification from the TOUR OPERATOR, but no later than 7 days before the start date of the trip, the USER should send a written declaration of will to the TOUR OPERATOR to make a choice among the following options:<\/span><\/p>

    1. To state that he accepts the changes in the clauses of the DOTP, to pay the additional amount due<\/span>\u00a0and to sign an additional written agreement to the contract<\/span>.<\/span><\/p>

    2. To state that he is withdrawing from the contract without paying a penalty or compensation, in which case the TOUR OPERATOR will refund the sums paid by the USER within 7 days of the written notification of cancellation of the trip.<\/span><\/p>

    3. To state that he accepts another trip of the same or higher quality when the TOUR OPERATOR is able to offer him one.<\/span><\/p>

    4. To state that he accepts a tourist trip with a total price of lower quality, in which case the TOUR OPERATOR is obliged to reimburse the\u00a0<\/span>THE USER<\/span>\u00a0the difference in price between the canceled and proposed trip.<\/span><\/p>

    (5)<\/span>\u00a0The price of the organized trip can be reduced.<\/span><\/p>

    (6)<\/span>\u00a0The USER is obliged to pay separately for additional services not included in the total price of the organized tourist trip.<\/span><\/p>

    V<\/u>. INSURANCE<\/u><\/span><\/span><\/p>

    Art. 5. (1)<\/span>\u00a0The TOUR OPERATOR declares and guarantees that it has a valid "Tour Operator Liability" insurance policy with the insurance company "EURO INS".<\/span><\/p>

    (2)\u00a0<\/span>The TOUR OPERATOR provides mandatory medical insurance for<\/span>\u00a0THE USER when traveling outside the Republic of Bulgaria, when it is included in the total price of the trip. The insurance is valid for the period of stay abroad, specified in the contract, under standard conditions of the relevant insurance company. The TOUR OPERATOR provides the USER with an original or a copy of the insurance policy before the start of the trip.<\/span><\/p>

    (3)<\/span>\u00a0At the USER's request, the TOUR OPERATOR can also insure him for other risks during the trip for an additional fee. The TOUR OPERATOR provides the USER with the opportunity to take out additional "Trip Cancellation" insurance under Art. 80, para. 1, item 14 of the Law on Tourism, covering the costs of canceling the trip, shortening and interrupting the trip, due to health reasons of the traveler, his relatives, urgent filing of a lawsuit, layoff from work, etc. The value of the insurance is calculated based on the final amount due under the contract, the age of the USER being important. Depending on it, the insurance value is between 3% and 8% on the total cost of the accident. The insurance is concluded on the day of signing the contract for an organized tourist trip and payment of the insurance value.<\/span><\/p>

    (4)<\/span>\u00a0USERS who have reached the age of 65 must be insured with an increased insurance premium. In these cases, each USER undertakes to pay the difference in the insurance value.<\/span><\/p>

    (5)<\/span>\u00a0USERS over 80 years of age should insure themselves with a licensed insurance company.<\/span><\/p>

    (6)\u00a0<\/span>When traveling with his own transport, the USER is obliged to insure himself at his own expense, if it is not expressly agreed in the DOTP that the total price of the trip includes insurance.<\/span><\/p>

    (7)<\/span>\u00a0In cases where the total price of the trip does not include medical insurance and the USER does not insure himself at his own expense, the TOUR OPERATOR is not responsible for the costs of treatment abroad, repatriation, etc.<\/span><\/p>

    V<\/u>I.<\/u><\/span>\u00a0RIGHTS AND OBLIGATIONS OF THE TOUR OPERATOR<\/u><\/span><\/strong><\/h4>

    Art. 6. (1)<\/span>\u00a0The TOUR OPERATOR undertakes to provide the User with the tourist services paid for by him, included in the Contract for an organized tourist trip.<\/span><\/p>

    <\/a>(2)<\/span>\u00a0THE TOUR OPERATOR has the right to\u00a0<\/span>spoiled<\/span>\u00a0the contract<\/span>,<\/span>\u00a0without incurring penalties<\/span>,<\/span>\u00a0if the USER does not make payments within the established terms and thus shows bad faith in fulfilling his obligations. If the USER has made a deposit, but has not made the payments up to the full amount of the total cost of the trip within the established terms, the deposit is not refunded.<\/span><\/p>

    (3)<\/span>\u00a0THE TOUR OPERATOR reserves the right to change the carrier with another in the event of reasons that make it impossible or inexpedient for the carrier specified in the contract to fulfill its obligations.<\/span><\/p>

    (4)<\/span>\u00a0The TOUR OPERATOR has the right to replace the hotel with one of the same category or higher in the same resort without changing the total price paid by the USER in cases of duplicate booking, closure of the relevant hotel or last-minute refusal of the hotel to accept the tourists.<\/span><\/p>

    (5)<\/span>\u00a0The TOUR OPERATOR reserves the right to change the time of departure in the event of a change of carrier or the occurrence of other objective reasons that require this, by notifying the USER in a timely manner.<\/span><\/p>

    (6)<\/span>\u00a0When traveling by bus, the TOUR OPERATOR accommodates the USER in the vehicle according to the date of registration for the trip, signing of the accident insurance and payment of a deposit. The TOUR OPERATOR has the right to change the USER's accommodation in the vehicle in order to accommodate mothers with children, disabled people, pregnant women, elderly persons and the like.<\/span><\/p>

    (7)<\/span>\u00a0In cases where the minimum number of USERS specified in the DOTP is not collected for the initial departure from the relevant city, the TOUR OPERATOR notifies the USERS within 7 days before the start date. USERS, for their part, travel at their own expense and individually to the town from which there is a confirmed departure. In case of impossibility of departure from another populated place and total cancellation of the program by the TOUR OPERATOR, the USERS will be reimbursed the full cost of the trip.<\/span><\/p>

    (8)<\/span>\u00a0THE TOUR OPERATOR reserves the right to make changes to its tourist products: hotel, vehicle, date and time of departure, route,\u00a0<\/span>if<\/span>\u00a0this does not significantly affect the tourist service<\/span>.<\/span><\/p>

    (9)<\/span>\u00a0In cases where the total price of the trip does not include medical insurance and the USER does not insure himself at his own expense, the TOUR OPERATOR is not responsible for the costs of treatment abroad, repatriation, etc.<\/span><\/p>

    (10)<\/span>\u00a0If a minimum number of participants for the specific organized tourist trip is specified in the DOTP, the TOUR OPERATOR may cancel the same by notifying the USER in writing no later than 7\/seven\/ days before the start of the trip and refund the amounts paid under the DOTP in full .<\/span><\/p>

    VII. RIGHTS AND OBLIGATIONS OF<\/u><\/span>\u00a0THE USER<\/u><\/span><\/strong><\/span><\/p>

    Art. 7. (1)\u00a0<\/span>The USER undertakes to pay the full amount of the price of the organized tourist trip within the terms agreed in the DOTP.<\/span><\/p>

    (2)\u00a0<\/span>When traveling outside Bulgaria, the USER is obliged to provide the necessary personal documents \/passport, identity card\/, drawn up in accordance with the laws of the country visited and of the Republic of Bulgaria.<\/span><\/p>

    (3)\u00a0<\/span>The USER undertakes to comply with the TOUR OPERATOR's instructions during the trip, including arriving on time at the assembly points specified by the TOUR OPERATOR's representative\/partner.<\/span><\/p>

    (4)\u00a0<\/span>The USER undertakes to comply with the legislation and customs of the country to which he is traveling.<\/span><\/p>

    (5)\u00a0<\/span>The USER declares that he is not a refugee and will not claim to acquire refugee status in a country along the tourist travel route.<\/span><\/p>

    <\/a>(6)<\/span>\u00a0If the USER is a person under the age of 18 and will be traveling abroad with his own foreign passport, he undertakes to provide and present to the border authorities of the Republic of Bulgaria a notarized declaration from both parents that they agree to travel alone in the specified country on the specified date (if the minor travels with one of his parents, he must have a notarized consent from the other parent).<\/span><\/p>

    (7)<\/span>\u00a0In a period between 10 and 7 working days before the start of the trip, the USER undertakes to visit the office or contact the TOUR OPERATOR in a way convenient for him, in order to be provided with the information under Article 86 of the TZ, including the following data: name or company , the address and telephone number of a representative of the TOUR OPERATOR in the visited place, and in the absence of a representative - data for establishing contact with the organizations in the visited place that can assist the USER in the event of a difficulty; when there is no such organization, the USER is provided with a telephone and fax number or an e-mail address to contact the TOUR OPERATOR\/Travel Agent; the times and locations of intermediate stops and connections; the type of means of transport used; insurance related to the performance of the contract. When the period between the conclusion of the contract and the start date of the trip is shorter than 7 working days, the information is provided to the USER when the DOTP is concluded.<\/span><\/p>

    (8)<\/span>\u00a0A USER who intends to travel and stay in countries with an increased risk of infectious diseases is obliged to undergo appropriate prophylaxis and vaccinations according to international medical requirements.<\/span><\/p>

    (9)<\/span>\u00a0The User may transfer his rights and obligations under\u00a0DOTP\u00a0<\/span>to a third party who meets all the requirements for making the trip, giving prior notice of this\u00a0in writing to the TOUR OPERATOR<\/span>\u00a0or\u00a0T<\/span>the heuristic agent\u00a0no later than 20 days before the start date of travel.\u00a0<\/span>PTHE DESTROYER<\/span>, who transfers his rights and obligations, and the person to whom the trip is transferred are jointly and severally liable to\u00a0THE TOUR OPERATOR<\/span>\u00a0to pay the total price of\u00a0DOTP<\/span>\u00a0and costs associated with the transfer.\u00a0The third party acquirer is obliged to declare that he agrees with the conditions of the DOTP and its annexes, these General Terms and Conditions, and that he is familiar with the information about the trip before accepting the transfer.<\/span><\/p>

    Transfer of rights to air excursions is not possible.<\/span><\/p>

    When traveling with an early check-in reservation, for any change of travel participant or travel date, if such are possible, a fee is due and paid in accordance with the conditions announced by the relevant hotel or provided for in the DOTP.<\/span><\/p>

    V<\/u>III. ACCOMMODATION<\/u><\/span><\/strong><\/span><\/p>

    Art. 8. (1)<\/span>\u00a0Check-in at the hotels upon arrival takes place after 2:00 p.m., a<\/span>\u00a0the release of the rooms - until 12:00, unless otherwise stated in the DOTP or if the TOUR OPERATOR has notified the USER in advance of other check-in and release times.<\/span><\/p>

    (2)\u00a0<\/span>Before check-in and after the last time for vacating the rooms, the USER has no right to use any services in the hotels, unless he\/she pays additionally for those used.<\/span><\/p>

    (3)\u00a0<\/span>The number of meals is determined depending on the number of nights booked and paid for in the respective mode: breakfast only, breakfast and dinner or\u00a0<\/span>All Inclusive\u00a0(all included).<\/span><\/p>

    (4)\u00a0<\/span>The USER bears personal responsibility for non-fulfilment or misuse of the diet.<\/span><\/p>

    <\/a>(5)\u00a0<\/span>When accommodating three people in a room with three beds, the TOUR OPERATOR does not guarantee the availability of standard three beds, because the third person benefits from a discount on the price. A third adult or children are accommodated in a standard bed only if a family room or suite is paid for.<\/span><\/p>

    (6)\u00a0<\/span>Accommodation in a room with a sea view or a room in the main part of the hotel is carried out if it is paid in advance by the USER.<\/span><\/p>

    I<\/u>H<\/u><\/span>. PENALTIES AND LIABILITY OF THE USER<\/u><\/span><\/strong><\/span><\/p>

    Art. 9. (1)<\/span>\u00a0The USER has the right to cancel the trip by notifying the TOUR OPERATOR in writing. The cancellation of the trip is carried out by the person who concluded the DOTP.<\/span><\/p>

    (2)<\/span>\u00a0In case of travel refusal by the USER, the TOUR OPERATOR deducts the following penalties from the amounts paid by the USER under the accident, unless otherwise provided for in the accident:<\/span><\/p>

    a) upon refusal of a trip made to\u00a0<\/span>3 days after concluding the DOTP and making a deposit, no penalties are deducted.<\/span><\/p>

    b) in case of refusal of a trip abroad, made after the expiry of the period under\u00a0<\/span>b.<\/span>"a"\u00a0and up to 60 days before the start date of the trip - a penalty in the amount of BGN 40. A fee of BGN 30 is deducted for any change regarding the reservation after the initial registration;<\/span><\/p>

    c) in case of refusal of a trip abroad made from 59 to 31 days before the start date of the trip - a penalty in the amount of the deposit;<\/span><\/p>

    d) in case of refusal of a trip abroad made from 30 to 21 days before the start date of the trip - a penalty in the amount of 50% of the total cost of the trip;<\/span><\/p>

    e) in case of refusal of a trip abroad made from 20 to 15 days before the date of the trip - a penalty in the amount of 80% of the total cost of the trip;<\/span><\/p>

    f) in case of cancellation of a trip abroad made less than 15 days before the start date of the trip - a penalty in the amount of 100% of the total value of the trip;<\/span><\/p>

    g) ) in case of refusal to travel in the country, made after the expiration of the term under b.<\/span>"a"\u00a0and up to 20 days before the start date of the trip - penalty in the amount of BGN 20;<\/span><\/p>

    h) in case of cancellation of a trip in the country made from 19 to 14 days before the start date of the trip \u2013 a penalty in the amount of the deposit;<\/span><\/p>

    i) in case of refusal to travel in the country, made from 13 to 7 days before<\/span>e<\/span>and the start date of the cancellation - a penalty in the amount of 50% of the total cost of the trip;<\/span><\/p>

    j) in case of refusal of a trip in the country made from 6 to 3 days before the start date of the trip - a penalty in the amount of 80% of the total cost of the trip;<\/span><\/p>

    k) in case of cancellation of a trip in the country made less than 3 days before the start date of the trip - a penalty in the amount of 100% of the total value of the trip.<\/span><\/p>

    l) In case of cancellation of a trip with an early check-in reservation, a penalty of 100% of the amount paid is due.<\/span><\/p>

    (3)\u00a0<\/span>In case of trip cancellation due to illness or other personal reasons related to the USER,\u00a0<\/span>including due to failure to submit necessary documents for visa issuance\/failure to pay visa fees\/failure to appear for a personal interview at the relevant embassy,\u00a0<\/span>he loses the sums paid to the TOUR OPERATOR according to the cancellation terms and the amounts of the fines according to the previous paragraph, respectively he owes an additional fine, in case the sums paid under the accident do not cover it.<\/span><\/p>

    (4)<\/span>\u00a0In the event that the USER does not show up on time on the day of departure, the TOUR OPERATOR deducts from the sums paid by the USER a penalty in the amount of 100 % from the total cost of the trip.<\/span><\/p>

    (5)<\/span>\u00a0In the event that the USER terminates the trip during its duration at his own will, all additional costs, including transport costs, are entirely at his expense, in which case the TOUR OPERATOR does not owe a refund of part of the trip price.<\/span><\/p>

    (6)<\/span>\u00a0In case of cancellation of plane tickets, the TOUR OPERATOR deducts\u00a0<\/span>100% of the total value of the tickets<\/span>\u00a0or the respective penalty according to the cancellation conditions of the specific air carrier. The TOUR OPERATOR has the right to deduct the incurred expenses from the sums paid by the USER.<\/span><\/p>

    (7)<\/span>\u00a0In the event that the USER turns out to be a refugee or does not have a visa for the relevant country - the destination of the tourist trip and is deported by regular flight or in another way to the Republic of Bulgaria or another country, all costs of this deportation are entirely at his expense. The USER also undertakes to compensate all damages suffered by the TOUR OPERATOR as a result of the deportation.<\/span><\/p>

    <\/a>(8)<\/span>\u00a0If the USER commits a violation of the legislation of the country in which the trip takes place, including the Republic of Bulgaria, and\/or shows a disrespectful attitude towards the social system, customs, traditions, religious beliefs, non-observance of personal safety rules, he bears\u00a0<\/span>full property, administrative and criminal responsibility for the violations committed by him of the normative provisions and the established moral rules of the country of the tourist trip, including for unused tourist services as a result.<\/span><\/p>

    (9) The TOUR OPERATOR is not responsible and does not owe a refund of the price paid for the tourist trip, if the USER is denied the opportunity to leave or enter the country where the trip takes place, including the Republic of Bulgaria, and\/or the opportunity to be transported in a vehicle or hotel stay.<\/span><\/p>

    H<\/u><\/span>. PROPERTY LIABILITY OF THE TOUR OPERATOR<\/u><\/span><\/strong><\/span><\/p>

    Art. 10 (1)<\/span>\u00a0In the event of non-fulfilment or inaccurate performance of the TOUR OPERATOR's obligations under the accident and resulting damages to the USER, the TOUR OPERATOR owes the USER compensation in the amount of the actually suffered and proven damages. The maximum amount of compensation is the value of the trip paid for by the USER.<\/span><\/p>

    (2)<\/span>\u00a0The TOUR OPERATOR is not responsible for damages caused by non-fulfillment or inaccurate fulfillment of the DOTP, if the reasons for this are due to:<\/span><\/p>

    a) THE USER<\/span>;<\/span><\/p>

    b) actions of a third party unrelated to the implementation of the DOTP;<\/span><\/p>

    c) force majeure or an event that cannot be foreseen or avoided by the TOUR OPERATOR and its counterparties in the conscientious performance of their obligations.<\/span><\/p>

    (3)<\/span>\u00a0The TOUR OPERATOR is not responsible to the USER in case of cancellation, delay or change of the terms and conditions of the trip, in the event that they do not depend on the TOUR OPERATOR, and are due to the delay\/cancellation of airplane flights for technical or meteorological reasons; delay\/cancellation\/interruption of the trip due to personal or force majeure circumstances; loss of or damage to baggage during travel; cancellation of the tourist trip due to third-party owners and\/or operators of the accommodations, etc.<\/span><\/p>

    (4)<\/span><\/em>\u00a0The TOUR OPERATOR guarantees that the information provided in its offices about the conditions of the offered tourist product is complete, objective and accurate. The TOUR OPERATOR is not responsible for typographical errors in the information on its website and in its advertising materials.<\/span><\/p>

    (5)<\/span>\u00a0On the date of conclusion of the DOTP TOUR OPERATOR provides the USER with information on the possibilities for additional services during the trip in the form provided to him by the foreign counterparty and is not responsible for its accuracy, as well as for subsequent changes in this information.<\/span><\/p>

    (6)<\/span>\u00a0The TOUR OPERATOR may cancel the trip in case of force majeure. In these cases, the TOUR OPERATOR is not responsible for the non-fulfillment of the Agreement, returning to the USER all paid sums, without that part of them for the actual expenses incurred \/paid insurances, fine for returned tickets, visa fees, etc.\/.\u00a0<\/span>The actual expenses incurred are certified by duly prepared documents.<\/p>

    <\/a>(7)<\/span>\u00a0Force majeure or circumstances beyond the TOUR OPERATOR's control, which exempt it from responsibility, are the following: worsening weather conditions; complicated road conditions, delays at border crossings, providing assistance to tourists, national and religious holidays, mass public events, strikes, military-political conflicts and restrictions, natural disasters, changes in the working hours of museums and sites, technical problems or vehicle accidents means immediately before travel or during travel and other exceptional circumstances. Force majeure or an event during the trip or immediately before it is considered a phenomenon that cannot be foreseen or avoided by the tour operator or its contractors in the performance of their obligations. In these cases, the TOUR OPERATOR reserves the right to move elements and changes in the program and actions according to a specific situation, without the TOUR OPERATOR being responsible and paying a penalty for this.<\/span><\/p>

    (8)<\/span>\u00a0THE TOUR OPERATOR is not responsible for the disappearance, loss, damage of the USER's luggage.<\/span><\/p>

    XI.<\/u><\/span>\u00a0DISPUTES AND COMPLAINTS<\/u><\/span><\/strong><\/span><\/p>

    Art. 11. (1)<\/span>\u00a0All disputes and complaints regarding the conclusion and implementation of the DOTP and<\/span>\u00a0these general conditions are decided by mutual agreement between the parties. In the event that this cannot be achieved, the same shall be referred to the competent Bulgarian court for examination and decision.<\/span><\/p>

    (2)<\/span>\u00a0In case of non-fulfillment\/inaccurate fulfillment of the DOTP, the USER is obliged to immediately notify and inform the TOUR OPERATOR or the Travel Agent in writing of the problem that has arisen, or to contact the TOUR OPERATOR by phone 02 954 42 30 or by e-mail:<\/span>\u00a0booking@journeygroup.bg<\/a>\u00a0in order to take timely measures and provide assistance to solve the problem.<\/span><\/p>

    (<\/span>3<\/span>)<\/span>\u00a0Complaints of the USER in connection with the services provided to him during the trip should be submitted on the spot to a representative of the TOUR OPERATOR or his partner at the place of the trip. If the USER's claims are not satisfied, he should request the drawing up of a tripartite protocol, certifying the claim and signed by the USER, a representative of the TOUR OPERATOR\/partner of the TOUR OPERATOR and a representative of the administration of the object providing the advertised tourist service.<\/span><\/p>

    (4)<\/span>\u00a0THE TOUR OPERATOR is not responsible for claims related to services,\u00a0<\/span>which are purchased and paid for on the spot by USERS. Complaints about these services should be submitted to the company from which they were purchased or to the person who provided them.<\/span><\/p>

    (5)<\/span>\u00a0Complaints of the USER that are not satisfied on the spot should be submitted to the TOUR OPERATOR no later than 7 days after the end of the organized tourist trip and should be accompanied by a copy of a tripartite protocol drawn up in accordance with paragraph 3 above.<\/span><\/p>

    (6)<\/span>\u00a0The TOUR OPERATOR gives a written opinion on the claims presented to him by USERS within 30 days of receiving them.<\/span><\/p>

    (7)<\/span>\u00a0Complaints that are not submitted by the USER on the spot and\/or are not submitted within the period under paragraph 5 will not be considered by the TOUR OPERATOR<\/span>.<\/span><\/p>

    <\/a>XII. ADDITIONAL CONDITIONS<\/u><\/span><\/strong><\/span><\/p>

    Art. 12\u00a0<\/span>(1)<\/span>\u00a0The TOUR OPERATOR declares and guarantees that the personal data provided by the USER are protected according to the GDPR, are processed and stored in accordance with the provisions of the applicable regulations.<\/span><\/p>

    (2)<\/span>\u00a0When the DOTP is concluded through a Travel Agent, the USER is obliged to contact him first for information, as well as in case of any problems and\/or complaints, and only in case of impossibility to solve them - to the TOUR OPERATOR.<\/span><\/p>

    (3)<\/span>\u00a0These General Terms and Conditions are subject to change with a 30-day notice to USERS, announced on the TOUR OPERATOR's website.<\/span><\/p><\/div><\/div><\/div><\/div><\/div>
